Evidence Establishes the FDIC Assigned WAMU Loans to Trusts


 

 

On August 30, 2012 at 12:02 PM a "Corporate Assignment of Deed of Trust" was recorded in Recorder's Office of Los Angeles County, California as Instrument #20121302084 for Washington Mutual Bank FA Loan for which a Deed of Trust made by John Manos was recorded May 18, 2007 as Instrument # 200071214434 for a property known as 5630 Foothill Drive, Agoura Hills, CA 91301.

The said Instrument states:

Contact JPMORGAN CHASE BANK, N.A. for this instrument 780 Kansas Lane, Suite A, Monroe, LA 71203, telephone # (866) 756-8747, which is responsible for receiving payments.
FOR GOOD AND VALUABLE CONSIDERATION, the sufficiency of which is hereby acknowledged, the undersigned, FEDERAL DEPOSIT INSURANCE CORPORATION, AS RECEIVER OF WASHINGTON MUTUAL BANK F/K/A WASHINGTON MUTUAL BANK,FA, WHOSE ADDRESS IS 700 Kansas Lane, MC 8000, MONROE, LA, 712-3, (ASSIGNOR), by these presents does convey, grant, sell, assign, transfer and set over the described Deed of Trust without recourse,representation or warranty together with all right, title and interest secured thereby, all liens, and any rights due or to become due thereon to U.S. BANK NATIONAL ASSOCIATION AS TRUSTEE AS SUCCESSOR BY MERGER TO LASALLE BANK, NATIONAL ASSOCIATION FOR WAMU MORTGAGE PASS-THROUGH CERTIFICATES SERIES 2007-HY7 TRUST, WHOSE ADDRESS IS 700 KANSAS LANE,MC 8000, MONROE,LA 71203 (866)756-8747, ITS SUCCESSORS OR ASSIGNS, (ASSIGNEE).
This Assignment was executed on August 10, 2012 for Federal Deposit Insurance Corporation, As Receiver of Washington Mutual Bank F/K/A by JPMorgan Chase Bank, National Association, its Attorney-in-Fact Melissa J. Riley whose Power of Attorney was recorded February 24, 2011 as Doc # 20110317.  It was notarized by Helen P. Tubbs on August 10, 2012 at Parish of Ouachita,State of Louisiana.

WHAT DOES THIS MEAN?

Now we have evidence of the FDIC's assigning WaMu loans to the Trusts for "valuable consideration" in violation of New York & Delaware trust laws and IRS REMIC provisions. This is quite unbelievable! So why this loan in particular? Without any schedules of assets ever being produced, how do they decide which ones will be assigned to the trusts from the FDIC, and which ones assigned from Chase? Either way it is illegal!
 
So now we know with certainty that at least some of the WaMu trust loans were retained on the books of WaMu, which violates the PSA's and the reps and warranties to the investors. There is no other way the FDIC can even attempt this assignment. So now what we have is the FDIC accepting "valuable consideration" for stolen merchandise and dumping the losses onto the REMIC investors. 
 
Equally interesting is that the designated "Lender" on the Deed of Trust of May 2007 was cited as "Washington Mutual Bank, FA" a bank that ceased to exist in 2005 according to the 2005 10-K filed by Washington Mutual Inc.  Other records indicate that in 2006 that Washington Mutual Bank had ceased doing business as Washington Mutual Bank, FA.
 
And so the plot thickens!

  1. Anyone have an documentation related to when WaMu,FA became formerly known as (FKA)? I have a Dec 06 loan alleged to be in the 2007 OA-1 trust. Anyone know why only 1 WaMu 2007 trust shows as registered in IRS publication #938? It all looks like a tax fraud!!!

  2. Helen Tubbs also notarized my Corporate Assignment of Deed of Trust... looks like she notarized quite a few. Would be interesting to request her notary log to see if she actually got the thumbprint and drivers license info of the Attorney in Fact who signed the assignment

    1. Louisiana does not require their notaries to keep log. However Helen P Tubbs was employed by Chase as recent as several months ago according to her, which would impute that for the first part of 2013 she was working for chase. At the least her signing as notary is a conflict of interest.

    2. ROBO signing is a comman practice among the WAMU certificates series bonds and it is illegal. If a person's name is on several loan/mortgage then this is your first clue to 'watch out' and seek out a handwriting expert.

    3. I have been researching to help my friend with his foreclosure for over 2 years. Tonight I have been looking up the signers of his recorded documents, as well as the notaries...to see if any of them were robo signers. At least one of his documents was signed by Helen P. Tubbs. And, when I got on this site and found her...I told him that I had found one robo signer. I told him that her notary commission expires "upon her death" and he wanted me to find out if anyone else had mentioned that oddity about her. Has anyone else noticed her commission saying that it expires upon her death?

      It was the vice president of jp Morgan Chase at 780 Kansas lane suite A (866)756-8747.What's going on is that attorneys are behide all this corrupt corporations with other to steal your properties.Do a search of the servicer with the state you live in.Am bursting it's SPSERVING there attorneys its all a scam that attorneys did.You won't find a attorney that would help you,they'll take your money and say they can help,but they won't, cuz they don't sue attorneys that's what they told me

  4. How can they get away with using the exact same address of "700 KANSAS LANE,MC 8000, MONROE,LA 71203" for all these different banks? I have found at least eight major banks all use this address on similar documents having to do with real property titles most of which have been created by Nationwide Title Clearing, who is located at 2100 alt 19 North Palm Harbor, FL 34683. They are notorious for having created forged real property title documents and they have and will continue to face litigation for same. Again my question is, How can they get away with using the exact same address of "700 KANSAS LANE,MC 8000, MONROE,LA 71203" for all these different banks?

    2. Helen P. Tubbs managed to earn the distinction of a Robo-signer. A mortgage assignment notarized by her on my NY mortgage which Chase (who does not own the mortgage) was assigning it to US Bank as trustee was so improper it's a joke! No where on the document is there a written name. Chase was not the original lender and the mortgage was never assigned to Chase yet Chase thinks they can assign to US Bank.!!! Chase starting its own Chain in Title. These banks are not even trying to be subtle. They even further have an undated allonge from the original lender to US Bank with rubber stamped signatories and no way in hell was the allonge attached to the note or was even near the note as borne out by the physical evidence. Will report further once my case is done.

    3. My Husband's and I Assignment to Deutsche Bank was signed by LaQuina Wilson Dooley claiming to be Vice President of Chase Bank USA, N.A. F/K/A/ Chase Manhattan Bank USA, N.A,.and the Notary Public for the State of Louisiana is Eve Reese. Who are these people? I mean really! What does the N.A. stand for - Not Applicable. When did Chase name become followed by USA? The USA ought to be ashamed of this country to allow their citizens who had a dream, plan or desire to become a homeowner be subjected to this abuse. This is our reward. Chase must have some heavy investors. Political affiliates you think?

  9. I've seen another one of these.....but not a WaMu loan. I couldn't believe it when I saw it. It solidified for me that the government was colluding with the bankers in this whole fraud against the homeowners. It will never allow me to live or think my current government is legitimate.

Yes, the government in some way some how are in bed with these crooked, the only way to get them is when they were cornered with no way out and they settle with case sealed. it has been that way long before we were born otherwise this Federal Reserve Note would not have been written on green dollar we that is called money. Through Actions for Justice ( AXJ ) they are organizing Qui Tam Actions around the country and representing the US Government and recuperating millions using the AGs and DAs or having them fired. The FBI must get involved and start the arrests. The Investors have been scammed and cannot foreclose on the properties since the notes and deeds of trust have been separated an the notes destroyed. All those filing and recording fraudulent docs on Title are committing felonies and all you must do is file the complaints. If you have MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC.   12. Remember, just because it says the FDIC assigned it doesn't make it true. There has also not been an acceptance of the assignment. Where's the attorney opinion letter and the tax filing document for accepting a loan after the cutoff date.

    Another thing, the assignment didn't assign the note! Think this was done on accident? They use to assign the note along with the DOT, not with these.

    1. Exactly. The FDIC admitted it didn't bother to look or identify what Chase received, and Chase has admitted they have no idea what they have, and there is no loan schedule. Seems to me they are working on closing protection letters only, which means they have no idea where anything is... It's like saying you own something that you found a receipt for. You don't really have it, only the information at the time of purchase.

What seems to be the case is that most loans had been securitized and sometimes the owner is not known but, Chase (or WAMU) may have been an investor and then Chase assumes it is the sole remaining investor when the security no longer has to report. The dilemma is when FNMA took an interest to insure the loan and became an investor as well.

  16. I have documents from May 2005 after Washington Mutual FA allegedly ceased to exist that clearly show "3" different entities conducting "3" different tasks. "Wamu", "Wash Mut FA", and "WMB".

    Now if WMB was WMB FA, why would they list both names. They wouldn't!

    Clearly they were still operating, fraudulently.
